Tulane University provides coverage under the terms of the Louisiana
Workers' Compensation Act for on-the-job injuries. The event causing the injury must arise out
of and be within the course of your employment. In all cases the Louisiana State Law determines
coverage. The benefits can include medical care for the injury, wage compensation, rehabilitation
services and death benefits. Benefits may be denied if the injury is a result of the employee's intoxication.
If you are hurt at work or become ill because of what you believe is a work-related incident or exposure, you must report your accident or ailment to your supervisor immediately. In turn, your supervisor will complete and sign a First Report of Injury form and forward the original report to the Office of Environmental Health & Safety within 24 hours. If you seek medical attention for this incident, you will need to inform the caregiver that the injury is possibly work related. You must present the caregiver with a copy of the First Report of Injury Form. Under the Louisiana Workers' Compensation Act, the caregiver must receive pre-certification in order to proceed with certain types of treatment and/or services and to guarantee payment of said treatment. You may be entitled to weekly compensation benefits if your injury prevents you from returning to work for more than seven calendar days. Benefits are payable beginning on the eighth day, and you should receive your first benefit check from our Third Party Claims Administrators within 14 days. You will be paid for the first seven days only if you are unable to work over 42 calendar days. Tulane will allow you to take accrued sick leave for the first seven days of missed time. For any employee who does not have accrued sick leave, the first seven days will be charged as a non-paid absence. If you are unable to work over 42 calendar days; and you used sick leave during the first seven days, you must endorse the check (for the first week of coverage) to Tulane. Tulane will credit/restore your sick leave in the amount of this check. Absences while on workers' compensation leave will run concurrently with the 12 weeks allowed under the Family Medical Leave Act. If an employee has been absent on workers' compensation leave for more than 12 weeks, the supervisor may hire a replacement. The employee will be eligible to seek alternate employment upon his/her return to work, if a position is available for which he/she is qualified.
